Sorry there has been a delay in posting lately folks, hopefully will record a new episode of The Card Podcast tonight. But this news came out last night that Topps has filed suit against Upper Deck over the Upper Deck 2009 O-Pee-Chee Brand using the same design as 1971 and 1975 Topps. The story follows after the link.

Here is the AP story from Yahoo.com here is the meat of the story though.

In its lawsuit, Topps described how it believes Upper Deck mimicked its design with just a few variations.

It said similarities between each company’s cards included the use of a colorful, divided two-tone border, the player’s photograph superimposed on a thin white border, the player’s autograph toward the bottom of the picture and the use of an image of a baseball on a bottom corner of the card.

Topps said its competitor’s cards will confuse or deceive customers because each of the Upper Deck designs are nearly identical to the Topps cards.

Topps asked that Upper Deck be ordered to destroy the cards and turn over any profits, along with other unspecified monetary damages.

Upper Deck has been putting up some great looking images through their facebook page, and we are bringing you them here today as well. This next preview is of the Upcoming Ultimate Hockey release. The rookie patches look fantastic, and anything with Bobby Orr on card autographs is ok with me. This was confirmed by the insane amount of the Score releases he was in that I purchased during the 90′s and never hit an autograph….. The images can be found at this link.

Last week for April Fools Day this thread was on FreedomCardBoard.com as my joke for that site. It was a mixture of everything that could get the internet buzzing. Wossamottau, the mysterious buyer on EBay who has to have the single best modern collection known to man, an enormous sale of a extremely high profile prospects best card, and myself to sell the entire thing. The following is the post I shared in the thread explaining the whole hoax, and how it went down. Also to start it off is a picture of Clay Buchholz, The Super in Question, and Lil’ Papi. We are running a contest as well for the picture that is shown above for this story. Clay was nice enough to sign a few things for me today, and if you sign up for FreedomCardBoard.com and post in that thread in the next few days, we will be giving a lot out.

So Gilmore IM’s me the other day trying to figure out a good April Fools joke for the site. We batted a few ideas around, from someone buying the board and turning it to a Non-Sports Board to Wossa buying the board and it never seeing the light of day again.

Gilmore went with the Yu Darvish signs with the Braves thread, but I decided to go with the Wossa hoax. I mean to steal a catch phrase from Stevie “Wossa + Nitro = Ratings” So I took a chance and sent Wossa a message via EBay asking if he was willing to participate in this wacky little hoax.

We had to make it look believable as possible. I debated back and forth with Wossa and Gilmore the format and every detail. We went over the price, whether we should do it on or off Ebay, on CollectorRevolution.com or just a post saying we sold it off Ebay.

We decided to do it on Ebay. A few insiders to the matter made offers on it instantly so it looked like there was action on it. Wossa even put in three offers right away to look like he hit the BIN out of frustration.

Also I did PM Bo before posting anything, if I was him and saw the thread without knowing, man would I be mad since he did a great thing helping me get the Super. He did not get the PM before seeing the thread I believe, so that part was actually 100% true.

So we kept searching on Ebay, and the card was not showing up other than by it’s direct link. We were hoping someone would just see it and go crazy, but that wasn’t happening even after three hours listed.

So who would be our mark to post it? Who wouldn’t get it was a joke and make a huge deal of it? Miggy….. When the thread went up and Bouwob guessed the exact number that would have won the card I figured Gilmore had let him in on it, he hadn’t. So now he was in on it too.

Through all of this, I actually was emailing back and forth about cards, baseball and laughing at the reactions with Wossa. We did actually end up doing a little business as well, I’m sending him a Connor Gillespie Game used jersey and helmet from his 2006 MVP season with the Falmouth Commodores. Again it was 100% true when I said I decided to sell him two items.

So people were now emailing me a bunch asking if this was legit. JP was one of the first two, so I let him in on it, and he posted the auction to other sites in exchange. MallCopKJ also posted it a few places since we talked about it.

We never expected it would take off like it has, I was glad that people finally started to get that it was comedic and started to run with that. The whole argument over bank check, money order or personal check had me and Wossa laughing a lot.

We had a plan to let this run to one of two occasions a) Sunday, I mean it’s Wrestlemania Sunday. What bigger staged event is there every year? The second option was until next Wednesday. I am going to the PawSox Welcome Home Luncheon, and we were watching everything to see if Clay was going to be sent to Pawtucket. You get to meet the whole team, so I was going to ask him to pose for a picture with the Super, and a sign that said “Wossamottau?” Lil’ Papi would be in the picture too…. That was why I laughed when Rainmanesq said something about us taking a picture of Clay, Wossa, Me and the Super as the big reveal. Honestly that as the final plan. I think if people hadn’t damn near rioted that would have been a great payoff.

Some of the pictures in this thread have been amazing and cracked me up. For people that thought I was trying to get attention for my site or anything, this really was just what I figured was the perfect combustible elements to have a thread of insanity on the board.

In closing interesting things that came out of the thread and hoax are the following, I found out Wossa pulled the Josh Reddick Super. I figured he would have it, that I would see the auction and get bummed out slightly. But he freaking pulled it!!!!

But I’m glad that this thread brought some laughs to the board. To the people who seriously got offended or took it personally, I’m sorry. I’m sorry that something that has zero impact on your lives at all got so much of a guttural reaction from you.

This thread had everything, and is the perfect representation of what fun you can have on this board. Look at how active any place else is, and look at what we accomplished in this thread. Over 7000 views and 700 posts since April 1st! Congrats Freedom Card Board!!! I’m proud to be a part of the biggest non-collector thread in this sites’ history that included for the most part no flaming and no Razor!

Best of Luck in All Your Future Endeavors,
Rob

PS – Also because of this we are negotiating with Wossa to contribute to my site. I really hope he does, he’s a great guy to talk cards and Baseball with. He has had for a while, and will always have an open invite to be on The Card Podcast. Oh yeah, he’s got a pretty nice card collection too.

Andrew aka All in Cards from FreedomCardBoard.com has had one of the best pulls in recent memory in his live group breaks on UStream. He pulled as pictured above the Matt Laporta 2007 Bowman Chrome Draft Picks and Prospects Superfractor. This isn’t the first huge card from this product that Andrew pulled, he also pulled the David Price / Luke Hochevar Head of the Class Super, but this is the first that he has got his hands on since the Price was never redeemed.
